I take it you mean, “if Barry had not ignored the ticket, he wouldn’t now be at the Supreme Court”.
Certainly in the 1st instance Barry took the wrong advice and ignored the ticket. However, had he appealed it, he would either have used an argument that would have had the ticket cancelled, or he would of lost. Had he lost and refused to pay, he might still have come to court to argue that the £85 charge represents a penalty.
The core issue doesn’t go away, and it doesn’t really matter who it is, or how it got there, the charges issued by private parking companies are either penalties, or the Supreme Court will need to modify the law to allow such charges.
